			<title type="html"><![CDATA[Notice:  Main entrance barrier damaged]]></title>

			<content type="html"><![CDATA[<p>Dear Home Owners and Residents<br />of Siam Royal View Pattaya Properties,</p><p>This week, a small accident happened at the front gate of the Siam Royal View village (Soi Khao Talo Entrance) by which the barrier on the way OUT was damaged. The barrier can still be operated manually, but your smart cards won&#039;t work for the time being.</p><p>Spare parts and repair were ordered immediately, but we assume that it will take the supplier some time to fix the barrier, because our gates are special size (much wider than ordinary barriers).</p><p>In the meantime, the security guards will open the barrier manually for you, but are still supposed to check the ID of the persons exiting the village. However, since this is on the way OUT, they will randomly check if the persons leaving the village are in possession of a smart card, especially if they cannot remember the person. Please note that&nbsp; you will need your smart card to operate the barrier when entering the village since the barrier on the way IN is functioning normally.</p><p>Please therefore bring your smart cards at all times when leaving the village, and please comply with the screening process by the security guards, if asked to show your smart card.</p><p>Thank you in advance for your understanding.</p><p>Best regards,<br />Siam Royal View Maintenance</p>]]></content>

			<title type="html"><![CDATA[City water supply low pressure]]></title>

			<title type="html"><![CDATA[Water Supply Switchover to City Notice]]></title>

			<content type="html"><![CDATA[<p>Apparently SRV sent a notice to quite a few of us about an imminent switchover of the water to city water.&nbsp; I did not see this notice,&nbsp; so I&#039;m attaching it here for everyone.&nbsp; &nbsp;We all are on limited time to get our own water connection to the city before SRV stops theirs. </p><p>~~~~~</p><p>In the past few months, we sent several letters to all home owners with the request to file their applications for city water connection. </p><p>Our latest letter covering this subject was dated Nov 2, 2011. We are sending you the letter again (see attachment) for your easy convenience. </p><p>For avoidance of any doubt, please note that your house No. 72 is definitely qualified for city water connection. </p><p>All you need to do is to file an application to the Provincial Water Authority (PWA). Our maintenance team will be happy to assist you with this process. </p><p>We do not understand why - in spite of many reminders of the request - you have not yet filed your application nor contacted our team for assistance for this purpose. Please explain what is your reason for not responding to our request. </p><p>In any case, please note that Siam Royal View will stop to supply water to your house through the temporary water supply system in the near future. </p><p>Siam Royal View was only authorized on a temporary basis to supply water to the houses as long as the PWA was not yet ready to provide direct supply to each house. 			<content type="html"><![CDATA[<p>Gil -</p><p>I&#039;m not sure which Sam you are writing to?</p><p>If it&#039;s me (the original poster on this topic), I could care less about you and even less what you believe.</p><p>I&#039;ve said many times - I have no interest in the HOA in it&#039;s current state and especially at this stage of the development - t&#039;s inappropriate and not in the best interests of the village right now.</p><p>If you truly cared about the village, you would consider the development as a whole and would try to appreciate other points of view for once, rather than your own?</p><p>And please don&#039;t keep bleating about &#039;mandatory&#039; and &#039;majority&#039; as your perception of majority and what is applicable appears somewhat confused</p><p>If there was indeed a compelling&nbsp; &#039;majority&#039; then why are the HOA still at an impasse with regards to the juristic body?</p><p>You&#039;re just trying to frighten the residents Gil and trying to take credit for things that SRV - not the HOA, are doing.</p><p>Per my post - SRV are trying to get things right in a difficult climate, I for one appreciate their efforts and I have found ways to work with them which have enhanced my quality of life and I am really quite satisfied with the way the village looks right now - the security appears to be working, the village is very tidy, the curbstones are all being placed, planting is underway, the power, Internet, tv and water supply are all relatively constant, the incremental services are really quite good and the baseline maintenance is reasonable for a village of this size and stature.</p><p>On the other hand, it would benefit the overall appearance of the village if some of the owners of the sold but vacant plots stepped up to their community responsibility and kept them tidy from time to time?</p><p>I also note with wry amusement that you didn&#039;t attempt to address any of the original questions, just responded with your usual empty rhetoric.</p><p>Sam (house 60) - i hope all is well for you and I agree with your position :-D</p><p>Rgds,</p><p>Sam 126 : a happy resident, minding my own business (when allowed to), enjoying my privacy, life in Thailand &amp; looking forward to continue to live peacefully in a world class village.</p>]]></content>

			<content type="html"><![CDATA[<p>Sam, you completely miss the point.&nbsp; A juristic is MANDATORY and required by Thai development law.&nbsp; What part of this did you not understand?&nbsp; The real issue is do we do it now, or do we wait for many years before homeowners start to take more ownership of OUR village.&nbsp; </p><p>All of the questions you mention are applicable to both SRV management and management by a democratically elected HOA.&nbsp; The difference is, currently we have no say in any part of the management, visibility into finances, quality control, etc.&nbsp; &nbsp; &nbsp;<br />Gil</p>]]></content>

			<title type="html"><![CDATA[HoA : Juristic Body (Open Questions)]]></title>

			<content type="html"><![CDATA[<p>Dear Homeowners -</p><p>It would appear that the intent of the HoA is to force through the formation of a Juristic Body, which may well be extremely detremental to the overall quality of life within Siam Royal View.</p><p>If you look at the relative successes and failures of Juristic Body&#039;s and Home Owners / Residents Associations, as with everything, there are good points and bad points.</p><p>For example, I have read repeatedly where owners associations have created rules and regulations that have led to residents being heavily &#039;fined&#039; by their own &#039;elected&#039; committee&#039;s, taken through the respective court systems for various reasons (including non-payment of fines imposed by the HoA), have had their properties re-possessed and subsequently sold by the HoA ... and this is not the worst of it!</p><p>I for one am completely against the formation of a Juristic Body at this juncture of the village&#039;s development and believe firstly that it is in our best interests (to ensure stability and focus), to ensure that the Management of this village continue to provide the services that they have been - Security, Maintenance, Landscaping, etc and that there are some very important questions outstanding that everyone should be cognizant of.</p><p>I am aware that at some time all of us (me included!) have had concerns with the management of Siam Royal View regarding either our properties (at an individual level) or services to the village (such as water supply and internet) and that we continue to worry about the long term prospects for the village and how this may eventually affect our investments and quality of life.</p><p>Whilst certainly not the easiest of companies to deal with at times, I have no issue at the moment with the services that are being provided - and this is nothing to do with any efforts of the HoA who are actually, completely toothless, yet appear willing to take credit for SRV&#039;s actions.</p><p>I have found a &#039;rhythm&#039; of interacting with SRV that works for me and have as a result, become far happier with my property and my standard of living within the village (I basically try to be reasonable in my expectations, unemotional in my communications - though I do get tested sometimes!, patient in working through issues and ignore unhelpful and rude people - which is what we should be doing in all walks of life?)</p><p>I think (of course their will be disagreements on this), that under this economic climate, SRV have done a very reasonable job of ensuring our security, that we live in a well tended and well maintained village and that they continue to spend money promoting the village in order to sell more properties - which will ultimately benefit all of us. </p><p>If individuals have issues with a service provider (developer, contractor, retail or commercial organization), they have recourse via either direct communication or ultimately, the rule of law and there are many laws to protect consumers ...</p><p>It&#039;s very different indeed if individuals have issues with services provided by a juristic body as technically, they represent the &quot;MAJORITY&quot; - once a committee is elected, they are acting on YOUR behalf, whether you like it or not!</p><p>Questions -</p><p>Do the homeowners understand that once the Juristic Body is approved and the committee is duly appointed, they are passing power of authority to the elected committee?</p><p>THIS MEANS THAT YOU ARE EFFECTIVELY ALLOWING OTHER PEOPLE TO MAKE DECISIONS ON YOUR BEHALF WHICH MAY ULTIMATELY AFFECT YOUR INVESTMENT AND THE WAY IN WHICH YOU LIVE YOUR LIFE.</p><p>I for one do not have faith in very many people to allow them to manage my life and also, my investments.</p><p>What qualifications, special skills, experience do the HoA have in evaluating and managing prospective service providers to the village?</p><p>What language capabilities (local and international) capabilities do the HoA have, both written and spoken to ensure effective two way communications between the residents and srvice providers?</p><p>How will the HoA conduct the necessary security and background checks of any prospective service providers and their employees - who will of course be entering our properties and subsequently, our lives?</p><p>What guarantees will the HoA be providing residents of the village regading the potential security issues resulting in from an influx of ever changing service providers?</p><p>A FRIEND OF MINE HAS JUST RESIGNED FROM HIS POSITION OF CHAIRMAN OF A JURISTIC BODY DUE TO THE DIFFICULTIES IN IDENTIFYING AND OF MANAGING LOCAL SERVICE PROVIDERS - NOT TO MENTION THE GROSS OVERCHARGING, INSTANCES OF THEFT AND INTIMIDATION BY SUPPLIERS AND THE INCUMBENT SERVICE DISPRUPTIONS TO THE RESIDENTS AND RESULTING FALLING STANDARDS OF SERVICES.</p><p>What guarantees are the HoA&nbsp; providing that we will not see substantial increases in maintenance and &#039;Juristic Body&quot; upkeep fees over the coming months?</p><p>WHO WILL PAY THE SALARIES AND MANAGE THE PEOPLE THAT SRV CURRENTLY PAY TO THE VARIOUS ADMIN &amp; SUPPORT PEOPLE THAT WILL NEED TO BE EMPLOYED TO MANAGE THE SERVICE PROVIDERS, PAY THEM AND GENERALLY KEEP THEM FOCUSED - WE WILL!</p><p>What guarantees are the HoA providing to ensure that should there be any issues of fraud, mismanagement of funds, cash flow, unforseen issues where costs significantly increase - the residents will not be expected to &#039;replenish any deficit of funds?&#039;</p><p>What guarantees are the HoA providing to ensure that we have improved security, maintenance, etc at the same cost levels?</p><p>How do the HoA propose to segregate the village - per SRV&#039;s notice to us?</p><p>I COMPLETELY UNDERSTAND SRV&#039;s POSITION HERE AND UNDERSTAND THE LOGIC CONTAINED WITHIN THE LETTER WHICH THEY RECENTLY DISTRIBUTED. IT IS A LUDICROUS CONCEPT TO HAVE ONE JURISTIC BODY FOR PHASE ONE AND ANOTHER FOR PHASE TWO - ARE THE RESIDENTS AWARE THAT THERE ARE POTENTIALLY FIVE PHASES TO THE SRV DEVELOPMENT?</p><p>I will close by saying that nothing is perfect, least of all me - but I do believe that at this juncture, SRV are trying hard to fulfill their responsibilties in a difficult economic climate, have the experience and the &#039;muscle&#039; to manage the various service providers and although they would like nothing better to not have a maintenence responsibilty - are stepping up to it right now.</p><p>I&#039;m sure that some of you have expensive, upsetting and very personal discputes with SRV - but that shouldn&#039;t take you down a path that could lead to a decision that may ultmately compromise the entire village ...</p><p>SRV - if you are listening guys - could certainly do better in communicating with us .. we are after all customers and possibly, your extended sales team! .. and I think that recently, they have been trying (I thought their recent letter was helpful)</p><p>The HoA in proposing a Juristic Body essentially run this village represents a huge risk to all of us (at the moment) as they don&#039;t have the experience, the time, the focus and the funding to run, manage and ensure the consistency of services that we need.</p><p>My final comment is that this posting is NOT A PERSONAL ATTACK AGAINST ANYBODY, INDIVIDUAL OR OTHERWISE and I am neither going to attend the HoA meeting nor respond to any criticism of this posting, nor participate any further in this issue.</p><p>With best regards to all fellow home owners and residents!</p>]]></content>
